SAN FRANCISCO BALLET’S

NUTCRACKER TICKET GIVEAWAY OPERA HOUSE  SCAVENGER HUNT

OFFICIAL RULES AND REGULATIONS


I.          Contest Periods.

The San Francisco Ballet’s Nutcracker Ticket Giveaway Opera House Scavenger Hunt (the “Contest”) begins at 12:30 p.m. (Pacific Time), December 16, 2011 and ends at 1:00pm (the “Contest Period”). 

II.        Sponsor.  

The sponsor of the Contest is San Francisco Ballet (“SF Ballet”), located at 455 Franklin Street, San Francisco, California 94102.

III.       Eligibility.  

The Contest is open only to natural persons who are legal residents of the United States.  The Contest is void wherever prohibited or restricted by law.  Contestants must be 18 years of age or older. Employees, producers and directors of SF Ballet, their respective affiliated and subsidiary organizations, advertising and promotional agencies and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize. Winners of the Nutcracker Ticket Giveaway Trivia Contests (11/22/2011 and 12/9/2011), the Nutcracker Ticket Giveaway Race to the Conservatory of Flowers (11/19/2011) and the Nutcracker Ticket Giveaway Race to the Exploratorium (12/3/2011) are not eligible to participate in the Contest.

IV.       Agreement to Official Rules.

Participation in the Contest constitutes a contestant’s full and unconditional agreement to and acceptance of these Official Rules and Regulations (these “Official Rules”) and the decisions of SF Ballet, which are final and binding.  Winning a prize is contingent upon fulfilling all requirements set forth herein.


V.        How to Participate and How the Winner is Selected.

At the beginning of the Contest Period, a miniature Nutcracker figure holding the Grand Prize (defined below) will be placed on the grounds of the War Memorial Opera House at 301 Van Ness Avenue, San Francisco, CA 94102.  The first contestant to locate the Nutcracker figure holding the Grand Prize and notify the SF Ballet staff member accompanying it, will win the Grand Prize.  In the case that the Nutcracker figure is simultaneously identified by two or more participants (the “Potential Winners”), the Potential Winners will be asked to answer a Nutcracker-related trivia question.   The first Potential Winner to answer the trivia question correctly will be the winner of the Grand Prize. 

After the Grand Prize is won, the next fifty participants (including the Potential Winners that did not win the Grand Prize) that discover the Nutcracker figure and notify the SF Ballet staff member accompanying it, will win a Runner-Up Prize.   

VI.       Prize.

The Grand Prize winner of the Contest will receive four tickets to the SF Ballet’s performance of the Nutcracker on December 20th 2011 at the War Memorial Opera House, 301 Van Ness Avenue, San Francisco, CA 94102 (the “Grand Prize”).

The winners of the Runner-Up Prize will each receive a promotional code that when used to purchase a ticket to the SF Ballet’s December 21st 2011 or December 22nd 2011 performance of the Nutcracker online at http://www.sfballet.org/will provide a discount of $10 off the purchase price (the “Runner-Up Prize”).

Some restrictions may apply.  The prizes are not transferable or substitutable for any other prize or cash; provided however that SF Ballet may substitute with a prize of equal or greater value in the event of prize unavailability.  Any and all prize-related taxes, gratuities, fees and other expenses, including any and all federal, state and local taxes, are the sole responsibility of the winners.

VII.      Release and Limitation of Liability.

By participating in The Contest, contestants agree to release and hold harmless SF Ballet and its affiliates, subsidiaries, licensees, sponsors and assigns (the “Released Parties”) from and against any and all actions, claims, injury, loss, damage or other liabilities arising in any manner, directly or indirectly, from participation in The Contest or the receipt of A prize, including, but not limited to: (a) any technical errors ; (b) unauthorized human intervention in the Contest: (c) errors in the administration of the Contest; (d) personal injury, property damage, death, illness or other injury or accident to person or property which may be caused, directly or indirectly, in whole or in part, from contestant’s participation in The Contest or receipt of A prize; or (e) technical, hardware or software malfunctions, lost or unavailable network connections, inability to access a website, fraud, incomplete, garbled, or delayed computer transmissions, whether caused by SF Ballet, users or by any of the equipment or programming associated with or utilized in the Contest.  Contestants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in The Contest, and in no event shall the Released Parties be liable for attorney’s fees.  Contestants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

SF Ballet reserves the right, in its sole discretion, to cancel or suspend part or all of the Contest, if in the SF Ballet’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Contest.

WARNING: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE SFBALLET.ORG OR ANY ONLINE SERVICE RELATED TO THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SF BALLET RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

SF Ballet’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. SF Ballet reserves the right to disqualify participants who violate the rules or interfere with the Contest in any manner. If a participant is disqualified, SF Ballet reserves the right to terminate that contestant’s eligibility to participate in the Contest.

VIII.    Disputes.

Except where prohibited, all contestants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, a contestant’s rights and obligations, or the rights and obligation of SF Ballet shall be governed by the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect.

IX.       Miscellaneous; Contest Prize Recipient List.

For the name of the winners of the Contest, send a self-addressed, stamped envelope to: San Francisco Ballet, 455 Franklin Street, San Francisco, CA 94102, Attn: Opera House Scavenger Hunt Contest, along with a request for the name of the winners.  SF Ballet reserves the right to make the names of the winners of the Contest public via SF Ballet’s Facebook page or Twitter @sfballet.

OFFICIAL RULES AND REGULATIONS

I.          Contest Periods. 

The San Francisco Ballet’sNutcrackerTicket Giveaway Race to the Exploratorium (the “Exploratorium Contest” or a “Contest”) begins at 10 a.m. (Pacific Time), December 3, 2011 and ends immediately upon a contestant winning the prize, as described below (the “Exploratorium Contest Period”).

II.        Sponsor.  

The sponsor of the Contests is San Francisco Ballet (“SF Ballet”), located at 455 Franklin Street, San Francisco, California 94102.

III.       Eligibility.  

The Contests are open only to natural persons who are legal residents of the United States.  The Contests are void wherever prohibited or restricted by law.  Contestants must be 18 years of age or older, must have access to the Internet and must have or register for either a twitter.com (“Twitter”) account or a facebook.com (“Facebook”) account. Employees, producers and directors of SF Ballet, their respective affiliated and subsidiary organizations, advertising and promotional agencies and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize.

IV.       Agreement to Official Rules.

Participation in the Contests constitutes a contestant’s full and unconditional agreement to and acceptance of these Official Rules and Regulations (these “Official Rules”) and the decisions of SF Ballet, which are final and binding.  Winning the prize is contingent upon fulfilling all requirements set forth herein.

Exploratorium Contest

Participants must download and print a copy of a coupon for discounted admission to the Exploratorium(the “ExploratoriumCoupon”), which will be made available by SF Ballet beginning 12 p.m. (Pacific Time) Wednesday, November 30, 2011 via Twitter @sfballet or SF Ballet’s Facebook page.  A participant must present a copy of the ExploratoriumCoupon at the Exploratorium’s ticket booth at 3601 Lyon Street, San Francisco, CA 94123 and purchase a discounted admission ticket (a “ExploratoriumDiscount Ticket Purchase”).  The first participant to make a ExploratoriumDiscount Ticket Purchase will be the winner of the ExploratoriumContest.  Once the prize has been won, a sign posted at or adjacent to the ticket booth will indicate that the ExploratoriumContest Period has ended. 

VI.       Prize.

The winner of the Exploratorium Contest will each receive two tickets to SF Ballet’s performance of the Nutcracker on December 10th 2011 at the War Memorial Opera House, 301 Van Ness Avenue, San Francisco, CA 94102.

Some restrictions may apply.  The prizes are not transferable or substitutable for any other prize or cash; provided however that SF Ballet may substitute with a prize of equal or greater value in the event of prize unavailability.  Any and all prize-related taxes, gratuities, fees and other expenses, including any and all federal, state and local taxes, are the sole responsibility of the winners.

VII.      Release and Limitation of Liability.

The San Francisco Ballet will sponsor two NutcrackerTicket Trivia Contests (each a “Contest” together the “Contests”).  The first contest begins at 1p.m. (Pacific Time), November 22, 2011 and ends immediately upon a contestant winning the prize, as described below.  The second contest begins at 1p.m. (Pacific Time), December 9, 2011 and ends immediately upon a contestant winning the prize, as described below.   

II.        Sponsor.

At the beginning of each Contest period, SF Ballet will post a trivia question via Twitter @sfballet.  Participants must submit a response to the trivia question to Twitter @sfballet.  Only one response may be submitted per participant.  A participant will be disqualified from the Contest if he or she submits responses via multiple Twitter accounts. The first participant to submit a correct response will be the winner of the Contest.

VI.  How a Potential Winner is Notified; Requirements of a Potential Winner.

SF Ballet will notify a winning contestant by direct message on Twitter.  The winning contestant will be asked to provide his or her full name in order to collect the prize at “Will Call” at the War Memorial Opera House, 301 Van Ness Avenue, San Francisco, CA 94102. The direct message will notify the participant that he or she will be disqualified from the Contest if the participant does not provide the requested information within forty-eight (48) hours after the direct message has been sent.  A winning contestant who does not respond to the direct message with his or her full name within FORTY-EIGHT (48) HOURS after the direct message is sent will be disqualified from the Contest.  If the winning contestant is disqualified the second participant to submit a correct response will be the winner of the Contest. 

The prize will be available for pickup at the box office of War Memorial Opera House, 301 Van Ness Avenue, San Francisco, CA 94102 from Dec 9 2011 (box office opens 10am). To collect the prize, the winner must present a valid photo ID.

VII.      Prize.

The winner of each Contest will receive two tickets to the opening night of the SF Ballet’s performance of the Nutcracker on December 10 2011 (1st contest) December 16 2011 (2nd contest) and at the War Memorial Opera House, 301 Van Ness Avenue, San Francisco, CA 94102.
