SAN FRANCISCO BALLET’S NUTCRACKER HOLIDAY CHALLENGE #6: YOUTUBE TICKET CONTEST – OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN

Monday, December 10, 2012 – Tuesday, December 11, 2012

 

1.              Description, Contest Entry Period and Sponsor:  The San Francisco Ballet Nutcracker Holiday Challenge #6: YouTube Ticket Contest (“the Contest") begins at 11am Pacific Time ("PT") on Monday, December 10, 2012, ending at 2pm PT on Tuesday, December 11, 2012  ("Contest Period").  The sponsor of the Contest is San Francisco Ballet ("SF Ballet"), located at 455 Franklin St, San Francisco, CA 94102.  The Contest is void wherever prohibited or restricted by law.  The Contest is subject to all applicable U.S. federal, state, and local laws and regulations. By entering, you agree to be bound by these Official Rules and the decisions of SF Ballet, which are final and binding in all respects. 
 

2.              Eligibility: The Contest is offered to natural persons who are legal residents of the 50 United States, who have Internet access, and who are 18 years of age or above (“Entrants”). Employees, producers and directors of SF Ballet, their respective affiliated and subsidiary organizations, advertising and promotional agencies and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize.  Limit one Entry per person and per email account.  If a person makes more than one submission, only the first submission will be recognized as an Entry and all other submissions will be ignored. Entrants may not create multiple email accounts to enter the Contest more than once, and anyone found using multiple accounts to enter will be ineligible to win.

 

3.              How to Enter: To enter the Contest Entrants must navigate the interactive YouTube challenge created by SF Ballet and hosted on http://www.youtube.com/sfballet and submit their contact details (name and email address) on the secret non-public SF Ballet webpage provided when the Entrant reaches the end of the YouTube challenge. Each submission of contact details to this secret non-public webpage will be recognized as an entry into the Contest (“Entry”). Limit one Entry per person and per email account.  Entrants may not create multiple names or email accounts to enter the Contest more than once, and anyone found using multiple accounts to enter will be ineligible to win.

 

4.              Judging:  At the end of the Contest Period representatives of SF Ballet will determine one winner (“Winner”) on the grounds of being the first Entrant to submit their contact details (name and email address) on the secret non-public SF Ballet webpage provided when the Entrant reaches the end of the YouTube challenge. The determination of the Winner will be at the sole discretion of SF Ballet, and shall be final and binding.
 

5.              Submission Requirements: Entries must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Failure to provide such proof may, if requested, render Entry null and void.  Entries must be free of profanity, references to sex, violence, drugs, alcohol, and/or inappropriate language. Entries must be in good taste and suitable for viewing by persons of all ages.  Entries cannot contain any offensive, obscene, inappropriate or sexually suggestive material, propaganda, potentially misleading information, or defamatory or disparaging material about SF Ballet or its programs or activities, other people or companies, or endorse any form of hate or hate group or terrorist activity, or discriminate on the basis of race, religion, creed, national origin, disability, handicap, age, gender, sexual orientation, marital status, veteran status, or any other basis prohibited by law.  Entries cannot directly promote or speak negatively about any particular faith, political action, legislation or party, or promote or encourage the violation of any law, as determined by SF Ballet at its sole discretion. Entries must not contain anything else that is not in keeping with the image of SF Ballet or that is not in compliance with these Official Rules. Please note that SF Ballet has the right, but not the obligation, to review and monitor entries.
 

6.              Agreements:  By submitting an Entry to SF Ballet, you hereby:
 

o   agree to be bound by these Official Rules including all eligibility requirements;
 

o   agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference, solely govern the relationship between Entrants and SF Ballet in connection with these Contest;
 

o    waive any privacy expectations that you may have with respect to any such Entry submitted by you to SF Ballet;
 

o   agree to hold SF Ballet and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any SF Ballet site, or any other use authorized under these Official Rules, of any Entry submitted to SF Ballet by you;
 

o   acknowledge that you are at least 18 years of age;

 

o   agree not to knowingly damage or cause interruption of the Contest and/or prevent others from utilizing the Contest.

CAUTION: ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SF BALLET MAY DISQUALIFY ANY PARTICIPANTS MAKING SUCH ATTEMPT AND SF BALLET MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
 

7.              General Liability Release:  SF Ballet assumes no responsibility for illegible, lost, delayed, misdirected or incomplete entries, system errors and failures, faulty transmissions, or other telecommunications malfunctions. SF Ballet reserves the right, in its sole discretion, to cancel or suspend part or all of this Contest if, in SF Ballet’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Contest. In such circumstances, the Contest may be cancelled by SF Ballet. In such event, SF Ballet may void any Entries that cause such a disruption and award prizes from among all eligible Entries received up to the date of cancellation.

SF Ballet reserves the right to cancel the Contest for any reason it deems appropriate. SF Ballet reserves the right to disqualify any Entry for any reason, in its sole and absolute discretion.  

8.              Anticipated Number of Contestants:  SF Ballet cannot accurately predict the number of Entrants who will participate in the Contest.  SF Ballet reserves the right to not choose a winner if it does not receive a sufficient number of eligible and qualified Entries.
 

9.              Prizes: The winning Entry will be awarded a prize of two tickets to Nutcracker on December 26, 2012 at 7pm PT, performed at the War Memorial Opera House, San Francisco, CA 94102.  Total approximate retail value of the prize is $350.
 

10.           Prize Conditions:  Any and all taxes and other costs, fees and expenses (including any additional travel-related costs) not specifically stated within these Official Rules as being awarded are the sole responsibility of the prize recipient. Prizes may not be transferred, substituted or redeemed for cash, except at SF Ballet’s sole discretion. Specifics of the prize are in SF Ballet’s sole discretion. The prize is subject to availability and SF Ballet reserves the right, in its sole discretion, to award a prize of equal or greater value if the advertised prize or a portion of the prize is unavailable.  SF Ballet shall not be responsible for any travel arrangements or liable for any damages or other harm suffered during travel.
 

11.           Prize Notification: The Winner of the Contest will be notified via email on Tuesday, December 11, 201 and asked via email for the Winner’s legal name in order to collect the prize tickets at the War Memorial Opera House Will Call (photo ID will be necessary to collect tickets). Tickets are not transferable. All reasonable efforts will be made to contact the first Entrant to submit their contact details to the non-public SF Ballet email address – however, if the winning entrant does not respond to SF Ballet within 48 hours, the prize will be awarded to the second-fastest Entrant.

 

12.           Publicity Release:  Except where otherwise prohibited, entry into the Contest and acceptance of the Prize constitutes permission for SF Ballet and its promotional agents to use the Winner’s name, likeness, and prize information in any and all media for any purpose including for commercial, advertising and promotional purposes without additional notice, compensation or consent..

 

13.           LIMITATION OF LIABILITY: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS SF BALLET; EACH OF ITS AFFILIATES, SUBSIDIARIES, DIVISIONS, PARENT AND RELATED COMPANIES, ADVERTISING AND PROMOTION AGENCIES, EMPLOYEES, OFFICERS, DIRECTORS AND SHAREHOLDERS; AND YOUTUBE (COLLECTIVELY, THE "RELEASEES") FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THIS CONTEST, INABILITY TO PARTICIPATE IN THIS CONTEST OR FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION OR INABILITY TO PARTICIPATE IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME PROVINCES WHERE IMPLIED WARRANTIES ARE PRESCRIBED BY LAW. Releasees are not responsible for lost, late, illegible, damaged, or stolen entries or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of Entry information, whether caused by SF Ballet, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Entry materials that have been tampered with or altered are void. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE YOUTUBE.COM OR ANY ONLINE SERVICE RELATED TO THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SF BALLET RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. SF Ballet’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. SF Ballet reserves the right to disqualify Entrants who violate the rules or interfere with this Contest in any manner. If an Entrant is disqualified, SF Ballet reserves the right to terminate that Entrant's eligibility to participate in the Contest.

The Contest is not administered, sponsored, endorsed by or associated with YouTube.

14.           Governing Law:  This Contest and these Official Rules are governed, construed and interpreted under the laws of the State of California and any or all claims pursuant to these shall be brought in the courts of the State of California. Any provision of these rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these rules will remain in effect.

 

15.           Winner:   SF Ballet will post the Winner’s name on sfballet.org, sfballetblog.org, Facebook.com, Twitter.com, tumblr.com, pinterest.com and plus.google.com.  To obtain the name of the Winner, send a self-addressed, stamped envelope to Nutcracker Holiday Challenge #6: YouTube Ticket Contest, San Francisco Ballet, 455 Franklin Street, San Francisco, CA 94102 for receipt.  All such requests must be received by February 14, 2013.

How to Enter: To enter the Contest Entrants must make a Pinterest Board entitled ‘San Francisco Holiday Spirit’ via http://www.pinterest.com showing what ‘San Francisco Holiday Spirit’ means to them. The Board must contain at least 10 images all tagged with the hashtag #sfballetnutcracker. Entrants must then email the url link of their Pinterest Board to nutcrackerchallenge@sfballet.org. Each Board meeting these requirements will be recognized as an entry into the Contest (“Entry”). SF Ballet will choose the winning Entry on the grounds of creativity and skill.

4. Judging:  At the end of the Contest Period, and assuming a sufficient number of submissions are received, representatives of SF Ballet will select one winner (“Winner”).  The determination of the Winner will be at the sole discretion of SF Ballet and will be based on the following criteria: (a) creativity (50%) and (b) or aesthetic impression (50%).  The determination of SF Ballet shall be final and binding.

5. Submission Requirements: Entries must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If a photo contains any material or elements that are not owned by the Entrant, and/or which are subject to the rights of third parties, the Entrant must have obtained, prior to submitting it, any and all releases and consents necessary to permit the use and exhibition of the photo including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. SF Ballet may request proof of these permissions from you at any time.  Failure to provide such proof may, if requested, render Entry null and void.  Entries must be free of profanity, references to sex, violence, drugs, alcohol, and/or inappropriate language. 1.              Description, Contest Entry Period and Sponsor:  The San Francisco Ballet Nutcracker Holiday Challenge #4: Twitter Ticket Contest (“the Contest") begins at 10am Pacific Time ("PT") on Monday, November 26, 2012, ending at 4pm PT on Thursday, November 29, 2012  ("Contest Period").  The sponsor of the Contest is San Francisco Ballet ("SF Ballet"), located at 455 Franklin St, San Francisco, CA 94102.  The Contest is void wherever prohibited or restricted by law.  The Contest is subject to all applicable U.S. federal, state, and local laws and regulations. By entering, you agree to be bound by these Official Rules and the decisions of SF Ballet, which are final and binding in all respects. 
 

2.              Eligibility: The Contest is offered to natural persons who are legal residents of the 50 United States, who have Internet access, and who are 18 years of age or above (“Entrants”). Employees, producers and directors of SF Ballet, their respective affiliated and subsidiary organizations, advertising and promotional agencies and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize.  Limit one Entry per person and per Twitter account.  If a person makes more than one submission, only the first submission will be recognized as an Entry and all other submissions will be ignored.  Entrants may not create multiple Twitter accounts to enter the Contest more than once, and anyone found using multiple accounts to enter will be ineligible to win.

 

3.              How to Enter: To enter the Contest Entrants must send one tweet on Twitter (http://www.twitter.com) written as if it had come from the Mouse King character from SF Ballet’s production of Nutcracker, as if that character wished to use Twitter to repair his bad reputation. The Entry must include SF Ballet’s Twitter name @sfballet and the hashtag #MouseKing.  Each tweet meeting these requirements will be recognized as an entry into the Contest (“Entry”). SF Ballet will choose the winning Entry on the grounds of creativity and skill.

 

4.              Judging:  At the end of the Contest Period, and assuming a sufficient number of submissions are received, representatives of SF Ballet will select one winner (“Winner”).  The determination of the Winner will be at the sole discretion of SF Ballet and will be based on the following criteria: (a) creativity (50%) and (b) relevance to the SF Ballet’s production of Nutcracker (50%).  The determination of SF Ballet shall be final and binding.
 

5.              Submission Requirements: Entries must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Entries must be free of profanity, references to sex, violence, drugs, alcohol, and/or inappropriate language. Entries must be in good taste and suitable for viewing by persons of all ages.  Entries cannot contain any offensive, obscene, inappropriate or sexually suggestive material, propaganda, potentially misleading information, or defamatory or disparaging material about SF Ballet or its programs or activities, other people or companies, or endorse any form of hate or hate group or terrorist activity, or discriminate on the basis of race, religion, creed, national origin, disability, handicap, age, gender, sexual orientation, marital status, veteran status, or any other basis prohibited by law.  Entries cannot directly promote or speak negatively about any particular faith, political action, legislation or party, or promote or encourage the violation of any law, as determined by SF Ballet at its sole discretion. 6.              Agreements:  By submitting an Entry to SF Ballet, you hereby:

10.           Prize Conditions:  Any and all taxes and other costs, fees and expenses (including any additional travel-related costs) not specifically stated within these Official Rules as being awarded are the sole responsibility of the prize recipient. Prizes may not be transferred, substituted or redeemed for cash, except at SF Ballet’s sole discretion. Specifics of the prize are in SF Ballet’s sole discretion. 11.           Prize Notification: The Winner of the Contest will be notified via a Direct Message on Twitter on Friday, November 30, 2012, and provided with an email address at which the Winner can contact SF Ballet. The Winner must be following @sfballet on Twitter in order to be contacted by Direct Message, and will be asked to do so if the Winner is not doing so already. The Winner will be asked via email for their legal name in order to collect the prize tickets at the War Memorial Opera House Will Call (photo ID will be necessary to collect tickets). Tickets are not transferable. All reasonable efforts will be made to contact winners – however, if the winning entrant does not respond to SF Ballet within 48 hours, the prize will be awarded to the second-favorite Entrant.

Monday, November 12, 2012 – Thursday, November 15, 2012

 

1.              Description, Contest Entry Period and Sponsor:  The San Francisco Ballet Nutcracker Holiday Challenge #2: Instagram Ticket Contest (“the Contest") begins at 11am Pacific Time ("PT") on Monday, November 12, 2012, ending at 4pm PT on Thursday, November 15, 2012  ("Contest Period").  The sponsor of the Contest is San Francisco Ballet ("SF Ballet"), located at 455 Franklin St, San Francisco, CA 94102.  The Contest is void wherever prohibited or restricted by law.  The Contest is subject to all applicable U.S. federal, state, and local laws and regulations. By entering, you agree to be bound by these Official Rules and the decisions of SF Ballet, which are final and binding in all respects. 
 

2.              Eligibility: The Contest is offered to natural persons who are legal residents of the 50 United States, who have Internet access, and who are 18 years of age or above (“Entrants”). Employees, producers and directors of SF Ballet, their respective affiliated and subsidiary organizations, advertising and promotional agencies and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize.  Limit one Entry per person and per Instagram account.  If a person makes more than one submission, only the first submission will be recognized as an Entry and all other submissions will be ignored.  Entrants may not create multiple Instagram accounts to enter the Contest more than once, and anyone found using multiple accounts to enter will be ineligible to win.

 

3.              How to Enter: To enter the Contest Entrants must upload a photograph to Instagram’s app illustrating the Entrant’s favorite tradition, to celebrate the status of SF Ballet’s Nutcracker as a holiday tradition itself. The Entrant must tag the image with @sfballet and include the hashtag #sfbtradition.  Each image uploaded to Instagram meeting these requirements will be recognized as an entry into the Contest (“Entry”). SF Ballet will choose the winning Entry on the grounds of creativity and skill.

 

4.              Judging:  At the end of the Contest Period, and assuming a sufficient number of submissions are received, representatives of SF Ballet will select one winner (“Winner”).  The determination of the Winner will be at the sole discretion of SF Ballet and will be based on the following criteria: (a) creativity (50%) and (b) aesthetic impression (50%).  The determination of SF Ballet shall be final and binding.
 

5.              Submission Requirements: Entries must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If a photo contains any material or elements that are not owned by the Entrant, and/or which are subject to the rights of third parties, the Entrant must have obtained, prior to submitting it, any and all releases and consents necessary to permit the use and exhibition of the photo including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. SF Ballet may request proof of these permissions from you at any time.  Failure to provide such proof may, if requested, render Entry null and void.  Entries must be free of profanity, references to sex, violence, drugs, alcohol, and/or inappropriate language. Entries must be in good taste and suitable for viewing by persons of all ages.  Entries cannot contain any offensive, obscene, inappropriate or sexually suggestive material, propaganda, potentially misleading information, or defamatory or disparaging material about SF Ballet or its programs or activities, other people or companies, or endorse any form of hate or hate group or terrorist activity, or discriminate on the basis of race, religion, creed, national origin, disability, handicap, age, gender, sexual orientation, marital status, veteran status, or any other basis prohibited by law.  Entries cannot directly promote or speak negatively about any particular faith, political action, legislation or party, or promote or encourage the violation of any law, as determined by SF Ballet at its sole discretion. Entries must not contain anything else that is not in keeping with the image of SF Ballet or that is not in compliance with these Official Rules. Please note that SF Ballet has the right, but not the obligation, to review and monitor entries.
 

6.              Agreements:  By submitting an Entry to SF Ballet, you hereby:
 

o   agree to be bound by these Official Rules including all eligibility requirements;
 

o   agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference, solely govern the relationship between Entrants and SF Ballet in connection with these Contest;
 

o    waive any privacy expectations that you may have with respect to any such Entry submitted by you to SF Ballet;
 

o   agree to hold SF Ballet and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any SF Ballet site, or any other use authorized under these Official Rules, of any Entry submitted to SF Ballet by you;
 

o   acknowledge that you are at least 18 years of age;

 

o   agree not to knowingly damage or cause interruption of the Contest and/or prevent others from utilizing the Contest.

7.              General Liability Release:  SF Ballet assumes no responsibility for illegible, lost, delayed, misdirected or incomplete entries, system errors and failures, faulty transmissions, or other telecommunications malfunctions. SF Ballet reserves the right, in its sole discretion, to cancel or suspend part or all of this Contest if, in SF Ballet’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Contest. In such circumstances, the Contest may be cancelled by SF Ballet. In such event, SF Ballet may void any Entries that cause such a disruption and award prizes from among all eligible Entries received up to the date of cancellation.

SF Ballet reserves the right to cancel the Contest for any reason it deems appropriate. SF Ballet reserves the right to disqualify any Entry for any reason, in its sole and absolute discretion.  

8.              Anticipated Number of Contestants:  SF Ballet cannot accurately predict the number of Entrants who will participate in the Contest.  SF Ballet reserves the right to not choose a winner if it does not receive a sufficient number of eligible and qualified Entries.
 

9.              Prize: The winning Entry will be awarded a prize of two tickets to Nutcracker on December 26, 2012 at 7pm PT, performed at the War Memorial Opera House, San Francisco, CA 94102.  Total approximate retail value of the prize is $350.
 

10.           Prize Conditions:  Any and all taxes and other costs, fees and expenses (including any additional travel-related costs) not specifically stated within these Official Rules as being awarded are the sole responsibility of the prize recipient. Prizes may not be transferred, substituted or redeemed for cash, except at SF Ballet’s sole discretion. Specifics of the prize are in SF Ballet’s sole discretion. The prize is subject to availability and SF Ballet reserves the right, in its sole discretion, to award a prize of equal or greater value if the advertised prize or a portion of the prize is unavailable.  SF Ballet shall not be responsible for any travel arrangements or liable for any damages or other harm suffered during travel.
 

11.           Prize Notification: The Winner of the Contest will be notified via an Instagram comment from SF Ballet (Instagram name @sfballet) on the winning Entry photo on Friday, November 16, 2012, and provided with an email address at which the Winner can contact SF Ballet. SF Ballet will then verify the Winner’s identity by requesting that the Winner post the phrase “I just won Week 2 of SF Ballet’s Nutcracker Holiday Challenge!” as a comment on the winning Entry photo from the Winner’s Instagram account to verify that the Winner is the owner of the winning account. After verification, the Winner will be asked via email for the Winner’s legal name in order to collect their prize tickets at the War Memorial Opera House Will Call (photo ID will be necessary to collect tickets). Tickets are not transferable. All reasonable efforts will be made to contact winners – however, if the winning entrant does not respond to SF Ballet within 48 hours, the prize will be awarded to the second-favorite Entrant.

 

12.           Publicity Release:  Except where otherwise prohibited, entry into the Contest and acceptance of the Prize constitutes permission for SF Ballet and its promotional agents to use the Winner’s name, likeness, and prize information in any and all media for any purpose including for commercial, advertising and promotional purposes without additional notice, compensation or consent.

13.           LIMITATION OF LIABILITY: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS SF BALLET; EACH OF ITS AFFILIATES, SUBSIDIARIES, DIVISIONS, PARENT AND RELATED COMPANIES, ADVERTISING AND PROMOTION AGENCIES, EMPLOYEES, OFFICERS, DIRECTORS AND SHAREHOLDERS; AND TUMBLR (COLLECTIVELY, THE "RELEASEES") FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THIS CONTEST, INABILITY TO PARTICIPATE IN THIS CONTEST OR FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION OR INABILITY TO PARTICIPATE IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. PARTICIPANTS AGREE THAT RELEASEES HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE CONTEST. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SF BALLET DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO TUMBLR.COM AND SF BALLET.ORG SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME PROVINCES WHERE IMPLIED WARRANTIES ARE PRESCRIBED BY LAW. Releasees are not responsible for lost, late, illegible, damaged, or stolen entries or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of Entry information, whether caused by SF Ballet, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Entry materials that have been tampered with or altered are void. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE TUMBLR.COM OR ANY ONLINE SERVICE RELATED TO THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SF BALLET RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. SF Ballet’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. SF Ballet reserves the right to disqualify Entrants who violate the rules or interfere with this Contest in any manner. If an Entrant is disqualified, SF Ballet reserves the right to terminate that Entrant's eligibility to participate in the Contest.

The Contest is not administered, sponsored, endorsed by or associated with Tumblr.

14.           Governing Law:  This Contest and these Official Rules are governed, construed and interpreted under the laws of the State of California and any or all claims pursuant to these shall be brought in the courts of the State of California. Any provision of these rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these rules will remain in effect.

 

15.           Winner:   SF Ballet will post the Winner’s name on sfballet.org, sfballetblog.org, Facebook.com, Twitter.com, tumblr.com, pinterest.com and plus.google.com.  To obtain the name of the Winner, send a self-addressed, stamped envelope to Nutcracker Holiday Challenge #1: Tumblr Ticket Contest, San Francisco Ballet, 455 Franklin Street, San Francisco, CA 94102 for receipt.  All such requests must be received by February 14, 2013.
